Drift has been a problem since the beginning, and the companies have ALWAYS known it. In the mid to late-90s, drift was even a problem for orchards. Trees were being burned something awful by drift.
It's only logical. You cannot train spray to only go in one place. Spraying on days with 5 mph winds or less was recommended, but you can't train the wind not to blow unexpectedly. Herbicide applications on crops has always been tricky. With the advent of STS, it became a real danger to neighboring crops of all kinds.

And Mulligan is correct, Ball no longer produces glass canning jars but I believe it was included in the story because people still associate Ball Co. with canning jars and they are a part of the SOCC.

Sueing for excessive drift may well be possible, but the suit would be against who applies the herbicide or fertilizers, not the company who manufactures it.
Suits may be filed, but Monsanto has deep pockets and this may end up dismissed just as the OGTA suit was also tossed; it's on appeal for being tossed, and will most likely continue to be dismissed.

http://saveourcrops.org/ I do finde as the OP said, that they are particularly nonrabid (nice change of pace) and are really more concerned with drift associated with 2,4-d, which does appear to be particularly risky. They aren't anti GMOers and aren't trying to be the leading edge of Monsanto or Dow's destruction. They seem to be taking factual and scientific approach. Also I see no mention of a lawsuit. They are petitioning the FDA and USDA. I think the motley fool reporter may have some fact problems. |
